Holiday Terms & Conditions

General Information and Booking Conditions 2008

 
Terms 

These terms and conditions set out the terms on which Tour Orkney and Shetland Ltd, a company incorporated under the Companies Acts in Scotland (registered number SC316470) and having its registered office at 8 Albert Street, Kirkwall Orkney, KW15 1HP, operating from 6 Crowness Place, Kirkwall, Orkney KW15 1RG agrees to provide to a customer ("you") a tour operator service, providing reservations for accommodation, guiding services, and where applicable, travel arrangements. Your agreement is with Tour Orkney and Shetland Ltd and the following conditions will form part of your contract and should be read with care.

 
Acceptance of Terms & Conditions 

By completing your booking, you acknowledge your understanding of these Terms & Conditions and agree to be bound by them in accordance with Scottish Law 

 
Price 

Prices are fixed once itinerary and Tour or Holiday has been accepted. 

 
Deposit and Final Payment 

For all arrangements a minimum deposit of 20% of total holiday value or £150 per person, whichever is greater, is required at time of booking. Full payment is required to be cleared no later than 56 days before departure, cancellation fees below apply. Payment can be made by cash, cheque or Bank transfer.  We do not accept Credit Cards. 

 
Alterations and Amendments By You. 

If you wish to alter your confirmed holiday arrangements in any way before departure, we will do our best to help. An administration charge of £25 per person will apply each time one of the elements of your booking is modified and you will be responsible for payment of any additional costs incurred as a result of any changes. However, once a holiday is booked, any alterations are subject to availability. Refunds cannot be made for any unused accommodation, services or transport.

 
Cancellation by you 

If, through circumstances beyond your control, you are compelled to cancel your Holiday, you should immediately notify Tour Orkney and Shetland Ltd by telephone and confirm the cancellation in writing immediately by first class post If you have to cancel the Holiday, for whatever reason, you may be able to transfer your holiday booking to a third party

*Any non refundable charges already made to secure facilities or transportation will be charged in addition to deposit

 
Alterations or Cancellations by Us

Tour Orkney & Shetland Ltd makes careful arrangements for transportation, hotels and service operators to ensure that we are able to provide you with the holiday accurately as we have described it. However, in exceptional cases, it may become necessary to make changes to your holiday itinerary (including ferry crossings, accommodation, services and transportation) due to circumstances beyond our control. Departure and arrival times are given as indications and finalised times will be shown on your confirmation. When minor changes are made we will do our best to ensure that they do not affect your holiday. If a major change is necessary (defined as a change of port, change of operator, a significant change of itinerary, a change of accommodation to a lower standard or a change of timing by more than 12 hours or we have to cancel your holiday, we will contact you and offer you a choice of

  • Accepting the change to you holiday
  • Purchasing another Tour Orkney & Shetland holiday
  • Cancelling your holiday with a full refund of monies paid to Tour Orkney & Shetland
  • none of above is applicabl in cases of force majeure, acts of war or strikes or disruptions, epidemics, or technical difficulties affecting transportation.

 

 
Liability and Insurance

Tour Orkney & Shetland Ltd is dedicated to ensuring that your holiday is as described in our offer. If you have a complaint about our holiday whilst travelling with us and you cannot solve it directly with the accommodation, attraction or transport supplier, please bring it to our immediate attention by phoning our care line07810 642 071. Liability cannot be accepted if you do not notify Tour Orkney & Shetland Ltd and your consumer rights to compensation may be affected. If after the holiday you are still dissatisfied, please send us your complaint in writing within 28 days of your holiday commencing. We will then follow up your complaint and respond accordingly. If a part of your holiday is not provided as promised, and this affects your reasonable enjoyment of your holiday, we shall pay compensation appropriate to the circumstances, providing you have filed a complaint with us at the time of occurrence and we receive a written statement from you with all facts listed. Compensation is limited to the cost of the service concerned. In so far as may be permitted by law, no responsibility will be accepted by Tour Orkney & Shetland Ltd, the Providers, or any of their agents whomsoever for any injury, accident or damage to persons or property, or loss or theft thereof arising howsoever or wherever, other than in the case of the fault or negligence of either the Providers or Tour Orkney & Shetland Ltd or their employees or agents.

 

Your Responsibilities 

All clients are responsible for obtaining the necessary travel documents. Non EU passport holders are responsible for checking visa requirements.

 
Insurance 

It is a requirement that all Tour Orkney & Shetland Ltd travellers have comprehensive travel insurance provision. Tour Orkney & Shetland Ltd will not be responsible for any losses, injuries or damages.

 
Financial Security 

In accordance with the requirements of the Package Travel, Package Holidays and Package Tours Regulations 1992, all monies will be held in our Client Account until successful completion of your holiday. 

 
Data Protection Act - Privacy Policy
Information requested by Tour Orkney & Shetland Ltd in terms of these conditions will only be used by Tour Orkney & Shetland Ltd for the purpose of providing you with the Holiday, updating their customer records, or contacting you for marketing and research purposes. Relevant information will be passed to the Providers in connection with your Holiday.
